The Court of Appeal has validated the election results of the La Horquetta/Talparo constituency, which was won by the People's National Movement's Maxie Cuffie.
Cuffie, who is now the Minister of Communications, has issued the following statement on the matter:
"I am gratified that today, the Court of Appeal, confirmed that my election as Member of Parliament for La Horquetta/Talparo was validly won. Today’s decision means that the appointment of the People’s National Movement on September 7, as the duly elected Government, can also no longer be legally challenged.
It is a decision which I never doubted and I look forward to similar validation of the other five constituencies in which there have been legal challenges. In the 2-1 decision which was handed down today, the Court of Appeal, the final appellate Court for election petition matters, threw out the Election Petition filed by the United National Congress, which sought to challenge the result of my election as Member of Parliament for La Horquetta/Talparo. The challenge had previously being thrown out by Madame Justice Mira Dean Amorer in the High Court on March 24, 2016.
The decision of The Honourable Chief Justice Mr. Justice Ivor Archie and Madame Justice Judith Jones with Mr. Justice Rajendra Narine dissenting, means that there can be no further legal challenge to my election. I wish to thank the voters of La Horquetta/Talparo who resoundingly reposed their confidence in me and have rejected all attempts by the UNC and its supporters to overturn the will of the electorate. Their prayerful support was instrumental in the victory of September 7 and I am even more emboldened to give them the kind of representation which they insist on and rightfully deserve.
I am also grateful to my legal team lead by Douglas Mendes SC and including John Jeremie SC, Michael Quamina, Terrance Bharath and Elena Araujo, for their excellent work in presenting a compelling, race that introduced some novel interpretations of the law.
During the campaign and subsequent to my election, I have been overwhelmed by the support and encouragement of members of the public and supporters of the People’s National Movement, for whom this result was never in doubt.
The validation of the court only reinforces my commitment to the job. We have a country to save."
